event shall Trek Equipment Corporation be liable for any damages caused by any
product or failure of such product to perform, whether or not
advised of the possibility of such damage and regardless of the
theory of liability pursuant to which such damages may be sought.
The limits of any liability shall be limited to the customers
original purchase price. |
Force Majeure
Trek Equipment Corporation shall not be
liable for loss or damages or delay due to causes beyond its
control, including, but not limited to, acts of Nature (GOD), acts
of the purchaser, fire, strikes, lockouts or other labor
disruptions, flood, epidemic, civil or military restrictions,
embargoes, vehicle related issues, wrecks, delays in transportation
or inability to obtain necessary labor or products. In the
event such delay has occurred the delivery will be extended for a
period equal to the time lost by the reason of the delay without
effect to the manufacturer's warranty and restrictions. |
Claims
If Customer makes
any claims against Trek Equipment Corporation, Customer agrees that the
venue for such claims will be in the State of California. As such, the laws of the State of California will govern these disclaimers, terms and conditions, without giving effect to any principles of conflicts of laws. Trek Equipment Corporation reserves the right to make changes to its site and these disclaimers, terms and conditions at any time. User hereby irrevocably and unconditionally consents to submit to the exclusive jurisdiction of the courts of the State of California and of the United States of America located in the State of California for any litigation arising out of or relating to use of or purchase made through trekequipment.com (and agrees not to commence any litigation relating thereto except in such courts), waives any objection to the laying of venue of any such litigation in the California Courts and agrees not to plead or claim in any California Court that such litigation brought therein has been brought in an inconvenient forum. Any dispute relating in any way to your purchase shall
be submitted to confidential arbitration. Arbitration shall be
conducted under the rules of the American Arbitration Association.
The arbitrator's award shall be binding and may be entered as a
judgment in any court of competent

Customer
Additional Charges
If necessary, Customer authorizes
Trek Equipment Corporation to charge their Credit Card or reimburse
Trek Equipment Corporation for any restocking or other charges, in addition to
the cost of the products to include shipping charges for any product
returned. |

Purchase Orders
